National service of Mediation and reconciliation. It is the permanent state body subordinated directly to the President of Ukraine which is created according to the Law of Ukraine “About the order of the sanction of collective work disputes (conflicts)” №137/98-SR from 03.03.1998 year, according to the Decree of the President of Ukraine “About formation of National service of Mediation and reconciliation” №1258/68 from 17.09.1998 year, with changes, which were Brought by decrees of the President of Ukraine №1393/2000 (1393/2000) from 30.12.2000, №272/2006 (272/2006) from 30.03.2006, №291/2007 (291/2007) from 11.04.2007, with the purpose of application of precautionary measures concerning occurrence of collective work disputes (conflicts), their duly sanction and definition of the general(common) tendencies in social-work relations, revealing of working collectives with the raised(increased) level of conflicts, search of ways of improvement of social-working relations.
Department of national service of Mediation and reconciliation in Donetsk region as the structural division of the state body carries out these functions accoding to the, assists and allows a disagreement and collective labour disputes (conflicts) between the sides of social - labour relations at all enterprises where there is a labour collective, provides observance of norms working legislative and legal regulation acts.
According to Regulations about to National service of Mediation and the reconciliation which was authorized by the Decree of the President of Ukraine №1258/9817.11.1998 year, the primary tasks of National service of Mediation and reconciliation are:
- Assistance in interaction of the sides of social-working relations during regulation of collective labour disputes (conflicts) that have arisen between them;
- Realization of actions on prevention of occurrence of collective labour disputes (conflicts);
- Forecasting occurrence of collective labour disputes (conflicts) and assistance to their timely solving;
- Realization of Mediation and reconciliation during the solving of collective labour disputes (conflicts).
According to articl №2 of the Law of Ukraine “About the order of the solving collective labour disputes (conflicts)”, the Department of National service of Mediation and reconciliation in Donetsk region considers(examines) collective labour disputes (conflicts) which arise between the sides of social-working relations on questions: establishments new or changes of existing social and economic working conditions and an industrial mode of  life; the conclusions or changes of the collective agreement, the agreement; performance of the collective agreement, the agreement or their separate positions; non fulfilment of the requests of the legislation on work.
According to article №17 of the Law of Ukraine “About the order of the solving of collective labour disputes (conflicts)” strike is a time collective voluntary cessation of work by workers (absence on work, default of the their labour duties) the enterprises, establishments, the organizations (structural division) with the purpose of the decision of the collective labour dispute (conflict).
